Terms of Trade of Holland Automotive
Introduction
These terms apply to all automotive repair and maintenance services provided and parts supplied by Holland Automotive to you, the Customer. By engaging our services, you acknowledge and agree to these terms.
Estimates and Quotes
- Estimates: An estimate provided by Holland Automotive represents a good faith effort to predict the likely cost of service and parts based on the initial assessment of your vehicle. Estimates are not binding, and the actual cost may vary. If, during the course of service, the expected cost exceeds the estimate by more than 10%, we will seek your approval before proceeding with additional work.
- Quotes: A quote represents a fixed price offer to perform the specified services and supply the necessary parts. Once accepted by you, the Customer, the quoted price will not change unless additional faults are discovered or additional services are requested by you. If unforeseen complexities arise or additional parts are required to complete the work to a safe and satisfactory standard, we will notify you immediately to discuss any additional costs and obtain your approval before proceeding. In such cases, we will provide a new estimate or quote for the additional work required
- Approval Process: For both estimates and quotes, any significant deviations from the initially agreed-upon scope of work or cost will be communicated to you for approval. Work exceeding the original estimate or quote by more than 10% will only proceed with your explicit consent. No additional work will be carried out without your approval.
- Validity: Quotes are valid for a period of 21 days from the date issued. If not accepted within this timeframe, a new quote may be required. Prices and availability of parts are subject to change beyond this period.
Parts and Labour Warranty
- New Parts Warranty: The warranty period for new parts and labor is 12 months or 20,000 kilometers (whichever comes first), covering defects in materials and workmanship. The exact warranty for new parts may vary depending on the manufacturer's warranty policy. Details of the manufacturer's warranty will be provided with your invoice.
- Used Parts Warranty: For used parts, any warranty provided will be stated on the invoice. The scope and duration of the warranty for used parts may differ and will be clearly communicated before installation.
- Customer-Sourced Parts: No warranty is provided by Holland Automotive for parts sourced by the customer. Installation of customer-sourced parts will be performed with the same level of care and skill, but we cannot guarantee the parts' performance or compatibility.
- Exclusions: Our warranty does not cover normal wear and tear, damage resulting from accidents or misuse, or if any subsequent modifications alter the work performed by us. Additionally, the warranty is void if the fault is due to external factors outside of the parts or labor provided by Holland Automotive.
Discovery of Additional Faults
- Notification: If, during the course of service, we discover faults not previously identified or disclosed, we will notify you of such faults and provide an estimate for the additional work.
- No Liability for Pre-existing Conditions: Holland Automotive is not responsible for any damage or fault that pre-exists or is discovered during our service that we did not cause. We commit to inform you of any such issues upon their discovery.
Limited Liability
- Care and Skill: We will perform all services with reasonable care and skill. However, our liability for loss or damage is limited to acts or omissions where we have not met our obligations to perform with reasonable care and skill.
- Maximum Liability: Our maximum liability will be limited to the cost of rectifying the services or parts provided, at our discretion.
- Indirect Losses: We are not liable for any indirect or consequential losses arising from our services.
Payment
Full payment is required upon collection of the vehicle. We accept cash, EFTPOS, ZIP, AfterPay, and MSD (WINZ). A deposit may be required for parts and materials, especially if custom parts are ordered. If any payment due is not made by the required date, the customer will be liable for any collection costs incurred in recovering the debt, including but not limited to legal fees and expenses.
Consumer Rights
Nothing in these terms will limit or exclude any rights you have under the Consumer Guarantees Act 1993. If there is a conflict between these terms and the Act, the Act will take precedence.
Privacy and Data Protection
We collect personal information in accordance with the Privacy Act 2020 and will not disclose your information to third parties without your consent, except as required to provide our services or by law.
Dispute Resolution
Should any dispute arise, we aim to resolve it amicably through direct communication. If resolution cannot be achieved, either party may seek mediation or arbitration as mutually agreed upon.
Amendments and Governing Law
We may update these terms, with the latest version available at our premises or website. These terms are governed by the laws of New Zealand.
